GERO3D PRIVACY POLICY (“PRIVACY POLICY”)

IMPORTANT: BY OPENING AN ACCOUNT AT, USING OR PLACING AN ORDER AT GERO3D LTD. (“COMPANY” OR “WE“) WEBSITE AND/OR MOBILE APPLICATION (“SERVICE“) YOU (“YOU“) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY. BY USING THE SERVICE, YOU CONSENT TO THE COLLECTION AND PROCESSING OF YOUR PERSONALLY IDENTIFIABLE INFORMATION (“PII”) AS DESCRIBED IN THIS PRIVACY POLICY AND IN ACCORDANCE WITH APPLICABLE LAW.

WE DEFINE “PII” TO MEAN ANY INFORMATION RELATING TO AN IDENTIFIED OR IDENTIFIABLE NATURAL PERSON; AN IDENTIFIABLE NATURAL PERSON IS ONE WHO CAN BE IDENTIFIED, DIRECTLY OR INDIRECTLY, IN PARTICULAR BY REFERENCE TO AN IDENTIFIER SUCH AS A NAME, AN IDENTIFICATION NUMBER, LOCATION DATA, AN ONLINE IDENTIFIER OR TO ONE OR MORE FACTORS SPECIFIC TO THE PHYSICAL, PHYSIOLOGICAL, GENETIC, MENTAL, ECONOMIC, CULTURAL OR SOCIAL IDENTITY OF THAT NATURAL PERSON.

YOU ARE NOT LEGALLY REQUIRED TO PROVIDE US WITH PII, HOWEVER, THE PII IS REQUIRED IN ORDER TO PROVIDE YOU WITH THE SERVICES. IF YOU CHOOSE TO WITHHOLD ANY PII REQUESTED BY US, IT WILL NOT BE POSSIBLE FOR YOU TO USE THE SERVICE. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS SET FORTH HEREIN PLEASE DO NOT USE THE SERVICE.

We recognize that privacy is important. This Privacy Policy applies to all of the services, information, tools, features and functionality available on the Service offered by the Company or its subsidiaries or affiliated companies and covers how PII that the Company collects and receives, including in respect of any use of the Service, is treated.   1. Information We Collect. In order to provide and improve our Service, understanding usage trends, user preferences, in order to adjust and personalize use of the Service, marketing and customer relations purposes, we may collect and process PII, including the following types of information: 

    1. Information You Provide. In order to use our Service and place orders we ask you to provide PII, including full name, phone number, age, height, weight and physical measurements (“Entered Data“). You are the source of such Entered Data, and such data may be processed for the purposes of providing the Services, ensuring the security of the Services, and communicating with You.

    2. User Communications. When you send an email or other communications to the Company, we may retain those communications in order to process your inquiries, respond to your requests and improve our Service.

    3. User Information. When you use the Service, we may automatically receive and record information from your browser or device, including without limitation information and statistics about your online/offline status, your IP address, internet service provider, search history, pages visited, impressions, links clicked, language preferences, the website visited before, date and duration of the visit per page or other item, type of browser or device, unique device identifiers, your regional and language settings and software and hardware attributes. Our systems may automatically record and store technical information regarding the method and nature of your use of the Service. An IP address is a numeric code that identifies your browser or device on a network, or in this case, the Internet. Your IP address is also used to gather broad demographic information. The Company uses all of the PII that we collect to understand the usage trends and preferences of our users. 

    4. Orders. We retain the information related to your orders and preferences. We use this information in order to provide services to our customers, manage loyalty programs and identify trends and personalize our services and advertisements. Payment cards information is submitted by you directly to a third party payment processor, subject to such third party’s terms of service and privacy policy and is not retained by the Company. The third party payment processor is identified in our terms of use. 

    5. Information Received from Third Parties. We sometimes supplement the information that you provide with information that is received from third parties. If you access the Service through any third party platforms (such as Facebook or Google), or interact with any third party platforms or other social media plug-in in the Service (such as a Facebook “Like” button) we may receive information from your respective social media or third party platforms account, including your account information, email, name, photo and any information defined as public pursuant to the policies of such third party platforms and/your settings in the respective third party platform. 

    6. Aggregate and Analytical Data. In an ongoing effort to better understand and serve the customers of the Service, we often conduct research on its customer demographics, interests and behavior based on the PII and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and we may share this aggregate data with our affiliates, agents and business partners. This aggregate information does not identify you personally. We may also disclose aggregated user statistics in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes. We also use aggregate data for monetization.

  2. Cookies. In order to collect the data described herein we may use temporary cookies that remain on your browser or device for a limited period of time. We may also use persistent cookies that remain on your browser or device until removed, in order to manage and maintain the Service and record your use of the Service. Cookies by themselves cannot be used to discover the identity of the user. A cookie is a small piece of information which is sent to and stored on your browser. Cookies do not damage your browser or device. Most browsers and devices may allow you to block cookies, but you may not be able to use some features on the Service if you block them. You may set most browsers or devices to notify you if you receive a cookie (this enables you to decide if you want to accept it or not). We may use remarketing services to inform you of new programs, blogs and opportunities by placing ads on third party web sites for you. We and our third-party vendors, use cookies to inform, optimize and serve ads based on your past visits to our Service (“Interest-Based Ads“). These Interest-Based Ads might be tailored to users exhibiting specific preferences or behaviors. Information used for Interest-Based Ads, including PI, could be supplied by You or derived from the usage patterns of specific users on the Services and/or third-party services. This information may be collected by tracking users’ activities over time and on unaffiliated platforms, even after leaving the Services. To facilitate this, We or our service providers may transmit Cookies, including a file known as a “web beacon,” from an ad network to your device through the Services. Web beacons or “gifs” are electronic images that may be used in our Service or in our emails. We use web beacons to deliver cookies, count visits and to tell if an email has been opened and acted upon. Additionally, web beacons empower third party vendors to deliver targeted ads to you when you visit other websites, by granting them the ability to view, modify, or establish their own Cookies on your browser, akin to your request for a web page from their site.


  1. Links. Links to other Service, sites and applications may be provided by the Company as a convenience to our users. The Company is not responsible for the privacy practices or the content of other sites and applications and you visit them at your own risk. This Privacy Policy applies solely to PII collected by us. 

  2. Children. Our Service is not intended for children under the age of 13. We do not knowingly collect PII from children under 13. If you are under 13, please do not provide any PII through the Service. If you are between 13 and 18, you should obtain parental consent before using our Service. If we become aware that we have collected PII from a child under 13 without parental consent, we will take steps to delete such information. If you believe that a child under 13 has provided us with PII, please contact us at the address provided above. 

  3. Information Usage, Legal Basis. 

    1. We collect and process your personal data only for the following purposes and on the following legal basis:

  • Providing and operating our Services and Sites. We process your personal data to perform our contract with you for use of our Services and Sites and to fulfill our obligations under applicable terms of use and laws. Where we have not entered into a contract with you, we process your personal data in reliance on our legitimate interests to operate the Services. 

  • Communicating with you about our Services and providing support. We may send you service, technical and other administrative messages in reliance on our legitimate interests in providing the Services. We also process your personal data to respond to your comments and questions and to provide support. We may be privy to or have access to some personal data of which you are a Controller – we do not use, retain or process such personal data for any purpose other than to provide You with support, and if required by You or by Law, for archival purposes only. 

  • Improving the Services and Sites as provided to you. We process your personal data to improve and optimize the Services as provided to You, and we use personal data of our Website’s visitors to understand how visitors reach, access and use our Website, including to monitor usage or traffic patterns and to analyze trends.

  • Maintaining security of the Services and Sites. We process your personal data to control unauthorized use or abuse of our Services, Website, or otherwise detect, investigate or prevent activities that may violate our policies or applicable laws, in reliance on our legitimate interests to maintain and promote the safety and security of our Website and Services.

  • Carrying out other legitimate business purposes. including support services, invoicing and fraud detection and prevention.

  • Complying with legal obligations. We process your personal data when cooperating or complying with public and government authorities, courts or regulators in accordance with our obligations under applicable laws and to protect against imminent harm to our rights, property or safety, or that of our users or the public, as required or permitted by law.

  1. In certain circumstances, we may collect your personal data on a different legal basis. If we do, or if we use your personal data for purposes that are not compatible with, or are materially different than, the purposes described above We will explain how and why we use your personal data in a separate notice and obtain your approval beforehand. 

  1. Information Sharing. We may share your PII with our affiliates, service providers, payment processing partners, and other third parties only as necessary to provide the Service and as described in this Privacy Policy in our terms of Use and on our Website. Our services require us to share information with pour advertising partners, analytics partners, business partners, agents and representatives, including AWS, Google cloud services, apple iCloud, Google (for other purposes) and Apple (for other purposes). . All such parties are required to process such information in compliance with this Privacy Policy and applicable data protection laws, and are bound by appropriate contractual safeguards. The Company may also share PII in the following limited circumstances: (a) as necessary for the provision, maintenance and improvement of the Service; (b) if we become involved in a merger, acquisition, or sale of assets, subject to the acquiring party’s agreement to protect such information in accordance with this Privacy Policy; (c) with your consent; (d) as required to comply with applicable law, legal process, or governmental requests; (e) as required for technical and operational purposes including error correction, bug fixes, updates, upgrades and other maintenance and support activities, and/or (e) to protect the rights, property, or safety of the Company, our users, or others, where we have a good faith belief that disclosure is necessary. 

  2. Information Security. We follow generally accepted industry standards to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of PII. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we implement commercially reasonable security measures to protect your PII, we cannot guarantee absolute security against all possible threats. We retain your PII only for as long as reasonably necessary for the specific purposes for which it was collected, to comply with applicable legal obligations, or to resolve disputes, but in no case longer than the shorter between: (i) the term required by applicable law and (ii) 5 years.

  3. Data Integrity. The Company processes PII only for the purposes for which it was collected and in accordance with this Privacy Policy or any applicable service agreements. We review our data collection, storage and processing practices to ensure that we only collect, store and process the PII needed to provide or improve our Service. We take reasonable steps to ensure that the PII we process is accurate, complete, and current, but we depend on our users to update or correct their PII whenever necessary. Nothing in this Privacy Policy is interpreted as an obligation to store information, and we may, at our own discretion, delete or avoid from recording and storing any and all information.

  4. Data Processing Limitations. We will not process your PII for purposes that are incompatible with the purposes for which it was originally collected, unless we have obtained your consent or are otherwise authorized by law. We will not retain your PII longer than necessary for the purposes set out in this Privacy Policy, except where longer retention is required or permitted by law. We reserve the right to anonymize or aggregate your PII for analytical and business purposes, provided such anonymized or aggregated data cannot be used to identify you personally.

  5. Your Privacy Rights and Choices.

    1. Depending on your location and subject to applicable laws, you may have certain data protection rights. If you are a resident of the EEA or the UK, you have the following data protection rights: 

  • Right of Access and Rectification. You have the right to know what PII we collect about you and to ensure that such data is accurate and relevant for the purposes for which we collected it. We allow our users the option to access and obtain a copy of their PII and to rectify such PII if it is not accurate, complete or updated. However we may first ask you to provide us certain credentials to permit us to identify your PII.

  • Right to Delete PII or Restrict Processing. You have the right to delete your PII or restrict its processing. We may postpone or deny your request if your PII is in current use for the purposes for which it was collected or for other legitimate purposes such as compliance with legal obligations. 

  • Right to Withdraw Consent. You have the right to withdraw your consent to the processing of your PII. Exercising this right will not affect the lawfulness of processing your PII based on your consent before its withdrawal.

  • Right of Data Portability. Where technically feasible, you have the right to ask to transfer your PII in accordance with your right to data portability. 

  • You may exercise the above rights by sending a request to support@gero3d.com.

  • Right to Lodge Complaint. You also have the right to lodge a complaint with a data protection supervisory authority regarding the processing of your PII. 

  1. If you are a California resident, you can find information about how we use your personal data and about your privacy rights in Section 14 of this notice below. 

  1. Enforcement. The Company regularly reviews its compliance with this Privacy Policy. Please feel free to direct any questions or concerns regarding this Privacy Policy or our treatment of PII by contacting us as provided above. When we receive formal written complaints, it is the Company’s policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of PII that cannot be resolved between the Company and an individual.

  2. Changes to This Privacy Policy. The Company may update this Privacy Policy. We will notify you about significant changes in the way we treat PII by sending a notice to the email address provided by you or by placing a prominent notice on the Service. We encourage you to periodically review this Privacy Policy for the latest information about our privacy practices.

  3. International Data Transfers.

  2. Collection and Use of Personal Data of California Residents.

  1. Scope. Except as otherwise provided, this part of the Privacy Policy applies only if you are a California resident. For purposes of this section, “Personal Information” has the meaning given in the California Consumer Privacy Act of 2018 (“CCPA“), the California Privacy Rights Act of 2020 (“CPRA“), and any regulations promulgated under either law, in each case, as amended from time to time. This Section does not apply to:

  • information exempted from the scope of the CCPA;

  • activities governed by a different privacy notice, such as notices we give to California personnel or job candidates; or

  • Personal Information we collect, use, and share on behalf of our customers as a “service provider” under the CCPA.

While we do not sell Personal Information for money, like many companies, we use services that help deliver targeted ads (also known as interest-based ads) to you, as we have described in the “How and Why We Use Your Personal Data” section above. The CCPA classifies our use of some of these services as “sharing” your Personal Information with the advertising partners that provide the services, from which you have the right to opt-out.

  • Right to Nondiscrimination. You are entitled to exercise the rights described above free from discrimination prohibited by the CCPA.

  • Right to Opt-Out of Tracking for Targeted Advertising Purposes. You can submit requests to opt-out of tracking for targeted advertising purposes by referring to our Cookie Policy. Your request to opt-out will apply only to the browser and the device from which you submit the request.

  • Verification of Identity. If we receive any request from You, we will use a two-step process for online requests where the California consumer must first, clearly submit the request and then second, separately confirm the request. 

We will use reasonable measures to verify the identity of any person making a privacy request. For security purposes, we may require additional verification steps before processing requests that could impact account security or involve sensitive information. We reserve the right to deny requests where we cannot adequately verify the requestor’s identity or where the request appears fraudulent. We will not process requests that are manifestly unfounded, excessive, or repetitive, and may charge a reasonable fee for such requests as permitted by applicable law.

  • Response Timing and Format. We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to an additional 45 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail.

Disclosures we provide may only cover the 12-month period preceding a California consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.
